法律争议案件按其所涉及的法律关系进行分类,可分为简单案件与复杂案件。洞穴奇案就是复杂案件的一个代表性案例,此案件的争议点在于几名行为人的杀人行为是否构成故意杀人罪。这些争议的观点与论据都是在为实现此个案的正义所付出的努力,目的都是为了追求法律的实质正义。通过对洞穴奇案的解读,可知影响一个裁判的正当性包括许多因素,这些因素中有的是形式上的,有些则是实质上的。一个具有正当性依据的裁判,应当是权衡不同价值取向所最终形成的最具合理性的裁判。

The legal disputes in the light of legal relations can be classified into simple and complex cases. Cave mystery is a representative case of complicated cases,and its controversial point is whether the homicidal act of perpetrators constituted intentional homicide. These controversial views and arguments in the effort to realize the justice of this case aim to pursue substantive justice law. Through the interpretation of cave mystery,we can see formal and substantial factors that affect the legitimacy of a judge. A judge with justified basis needs to weigh different values to form the most reasonable judgement.
